Information
on how to enter forms part of these conditions of entry. The entrant is
responsible for ensuring their familiarity with the conditions of entry at the
time of participation. Participation in this promotion constitutes acceptance of
these conditions of entry.
Entry
to the promotion is open to all eligible entrants aged at least 14 years and
who fulfil the entry requirements.
Directors, management,
employees, officers and contractors (and their immediate families) of the
Promoter or of the agencies or companies associated with this promotion are
ineligible. “Immediate families” means spouse, parent, guardian, natural or
adopted child, and sibling (whether natural or adopted by a parent), whether or
not they live in the same household as the director, manager, employee, officer
or contractor.
The
Promotion begins on 17/09/2009 and closes 11.59.59pm (Melbourne time) on 12/11/2009 (Promotion Period).
To
enter, entrants must go online to www.sologameon.com.au and select to play the ‘Solo Kick the Can’ game (Game) by clicking on ‘Play Now’. To play the Game for prizes
entrants then click on ‘Play for Prizes’ and play the Game. Entrants can submit
their score at any time during the Game by clicking on ‘Submit Score’.
Once
an entrant submits their score, if it qualifies as one of the Top 100 highest
scores at that point in time, it will be entered on the Top 100 leader board
and the entrant will have a chance to win a weekly prize. The Top 100 leader
board is a list of the highest scores achieved by entrants who have played the
Game and submitted their score during that week. Each week after the draw
takes place the leader board will be reset. Entrants may only have one entry on
the Top 100 leader board at any given time.
The
winner of the weekly prize draw will be randomly drawn from those entrants on
the Top 100 leader board at the time of the draw. The highest score on the Top
100 leader board does not automatically win the weekly prize.
The
Promoter accepts no responsibility for late, lost, incomplete, incorrectly
submitted, delayed, illegible, corrupted or misdirected entries, claims or
correspondence whether due to error, omission, alteration, tampering, deletion,
theft, destruction, transmission interruption, communications failure or
otherwise. The Promoter has no control over mobile telephone communications,
networks or lines and accepts no responsibility for any problems associated with
them, whether due to traffic congestion, technical malfunction or otherwise.
The Promoter is not liable for any consequences of user error including
(without limitation) costs incurred.
All
draws will be conducted at Salmat Interactive, Innovation Place, Level 17, 100 Arthur Street, North Sydney, NSW 2060, Australia.
A weekly prize draw (Weekly Prize Draw) will be conducted at 3:00pm on each of
the following dates:
24/9/2009;
1/10/2009;
8/10/2009;
15/10/2009;
22/10/2009;
29/10/2009;
5/11/2009; and
12/11/2009.
There
are a total of eight (8) Weekly Prize Draws.
The
first valid entry randomly drawn in a Weekly Prize Draw will win a Weekly
Prize. Each weekly prize is a signed football jersey and Solo football pack,
and comprises:
Signed
Harry Kewell jersey;
Harry Kewell Solo branded water bottle;
Thirst Crushing SOLO selection;
‘I am a Solo man’ t-shirt; and
Solo Game On cap.
Each weekly prize is
valued at AU$300 (incl. GST).
All
entrants who submit their score will also be eligible to go into the draw (once
each week of the Promotion Period) to win the Major Prize. Each entrant will
be eligible receive a maximum of 8 entries into the draw for the Major Prize. There
is one Major Prize to be won.
The
Major Prize comprises:
Solo branded Foosball table; and
Solo football pack including back pack, ball,
scarf and cap.
The Major Prize is
valued at up to AU$1900 (inc GST).
If the winner of a prize
is under 18 years of age, the prize will be awarded to the winner’s parent or
guardian.
Total
prize pool: up to $4300 (incl. GST).
At
the Promoter’s request, winners must, and where relevant, must procure that
participants, participate in all promotional activity (such as publicity and
photography) surrounding the winning of the prize, free of charge, and they
consent to the Promoter using their name and image in promotional material.
The
Promoter, its associated agencies and companies, and the agencies and companies
associated with this promotion will not be liable for any loss (including,
without limitation, indirect, special or consequential loss or loss of
profits), expense, damage, personal injury or death which is suffered or
sustained (whether or not arising from any person’s negligence) by any person
in connection with this Promotion or accepting or using a prize, except for any
liability which cannot be excluded by law (in which case that liability is
limited to the minimum allowable by law).
The
Major Prize will be drawn on 18/11/2009 at 3:00pm.
Winners
will be notified by telephone and email and published in The Australian on 27/11/2009.
The Promoter may also
publish the name and the State/Territory of residence of the winner on its
website or in a trade publication. By entering this Promotion, each entrant
requests that his or her full address not be published.
Prizes
are not transferable or exchangeable and cannot be redeemed for cash or any
other form of compensation. In the event for any reason a prize winner does
not take an element of the prize at the time stipulated by the Promoter, then
that element of the prize will be forfeited by the winner and neither cash nor
any other form of compensation will be supplied in lieu of that element of the
prize. The value of the prize is accurate as at the commencement of this
promotion. The Promoter accepts no responsibility for any variation in the
value of a prize after that date. If for any reason a prize is not available,
the Promoter reserves the right to substitute another item for it, in its sole
discretion, of equal or higher value, subject to the approval of the gaming
authorities in each State/Territory, where relevant.
Participants
must comply with all requirements of the Promoter including requirements
specified in the conditions of entry. The Promoter may, at its absolute
discretion, declare any or all entries made by an entrant invalid if the
entrant:
considers, in its absolute discretion, that there has been excessive
use/manipulation by an entrant;
fails to establish their entitlement to enter the Promotion to the
Promoter's satisfaction;
tampers with or benefits from any tampering with the entry process
or the operation of the Promotion;
submits an entry which in the Promoter's opinion is not in
accordance with these conditions of entry; or
acts in a disruptive manner or acts with the intent to annoy, abuse,
threaten or harass any other person.
The
Promoter may require entrants to validate any one or all of their entries in
the promotion at any time during the promotion prior to being eligible to claim
a prize. The Promoter may require the winner to provide proof of identity,
proof of age, proof of residency at the nominated prize delivery address and/or
proof of compliance with any other eligibility or entry criteria.
Identification considered suitable for verification is at the Promoter’s discretion.
After identification documents available have been established, if requested,
an entrant must deliver copies within 7 days of being asked to do so. At the
Promoter’s request, an entrant must also, allow the Promoter to inspect and
copy the original of any such documents within 7 days of being asked to do so.
If a
winning entry is deemed not to comply with the terms and conditions of this
promotion, the entry will be discarded and a new winner of that prize will be
determined by drawing a further valid entry.
The
Promoter’s decision is final and no correspondence will be entered into.

Promoter’s decision not to enforce a specific condition does not constitute a
waiver of that condition or of the conditions of entry in general.
If
for any reason any aspect of this promotion is not capable of running as
planned, including by reason of infection by computer virus, mobile network
failure, bugs, tampering, unauthorised intervention, fraud, technical failures
or any cause beyond the control of the Promoter which corrupts or affects the
administration, security, fairness, integrity or proper conduct of this
promotion, the Promoter may in its sole discretion cancel, terminate, modify or
suspend the promotion, or invalidate any affected entries, subject to the
approval of the gaming authorities in each state and territory, where required.
The
Promoter accepts no responsibility for any tax implications that may arise from
the prize winnings. Independent financial advice should be sought. Where the
operation of the promotion results in, for GST purposes, supplies being made
for non-monetary consideration, entrants agree to follow the Australian
Taxation Office’s stated view that where the parties are at arm’s length, goods
and services exchanged are of equal GST inclusive market values.
In
the event of any prize not being accepted or claimed within 3 months of the
draw, the winner’s entry will be deemed invalid and the Promoter reserves the
right to conduct such further draws on 22/02/2010 at the same time and at same
location as the original draw as are necessary to distribute the prizes. Any
winner will be notified in writing and the name and State/Territory of
residence of winner will be published in The Australian on 8/03/2010.
All
entries will be the property of the Promoter. The information entrants provide
will be used by the Promoter for the purpose of conducting this promotion and
for the other purposes of collection as set out in the Promoter’s privacy
policy. The Promoter may disclose entrants’ personal information to its
contractors and agents to assist in conducting this promotion or communicating
with entrants and to State and Territory lottery departments and winners’ names
may be published as required under the relevant legislation. The Promoter is
bound by the National Privacy Principles in the Privacy Act 1988 (Cth).
